Residence Permit for Vocational Training (Ausbildung) in Germany: A Simple Guide for Applicants with Duldung Status
As of March 1, 2024, Germany’s new immigration law offers a new opportunity for individuals who are required to leave the country (those with Duldung status – temporary suspension of deportation). Under Section 16g of the German Residence Act (AufenthG), these individuals can obtain a legal residence permit by starting a vocational training program (Berufsausbildung) in Germany.
To benefit from this opportunity, you must meet the following conditions:
Having held Duldung status for at least 3 months: This requirement may be waived if you began the training during the asylum application process.
Starting or continuing a recognized vocational training program: You must have a contract or confirmation from a certified training institution.
Proof of financial self-sufficiency: You must show that you can cover your living expenses. This can be through vocational training salary, a blocked bank account, or financial aid such as Berufsausbildungsbeihilfe (BAB).
Proof of identity and valid identification documents: You must verify your identity and submit valid ID documents.
No legal obstacles: There must be no reasons for your application to be denied, such as a criminal record or being considered a threat to public security.
Legal stay during the training period: You can legally reside in Germany for the duration of your vocational training.
Permission to work part-time: You are allowed to work up to 20 hours per week.
Access to language courses and integration services: You can attend German language courses and social integration programs.
Pathway to permanent residency: After successfully completing your training and meeting further requirements, you can apply for a permanent residence permit.
After finishing your vocational training:
Apply for a two-year work residence permit: If you find a job related to your training, you can apply for a two-year residence permit for employment.
Option to extend your residence: If you remain employed and continue meeting the requirements, you can extend your residence and eventually apply for permanent residency.
If your training is interrupted for any reason:
Six-month grace period to find a new program: You have up to 6 months to find a new vocational training opportunity and maintain your residence permit.
